ORDER

This writ petition has been filed seeking a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 25.06.2025 and to direct the 2nd respondent to appoint the Petitioner on compassionate ground in view of the death Mr. (late) Paulsamy, commensurate with the qualification of the Petitioner.

2. Heard Mr.M.Madhuprakash, learned counsel for the petitioner and Mr.S.Ramachandara Pradeep, learned Standing Counsel appearing for the respondent Corporation.

3. With the consent of both the parties, the writ petition is being disposed of at the admission stage itself. 2/7

The case of the petitioner is that his father late.Paulsamy while working as a Conductor in the respondent Corporation, died on 19.01.2014 and therefore, the mother of the petitioner made an application for seeking compassionate appointment to the petitioner and the petitioner also submitted a representation dated 25.06.2025 to the second respondent requesting for compassionate appointment. However, the said representation was stated to be still pending for consideration and hence, the petitioner approached this Court by filling the present writ petition.

Mr.S.Ramachandara Pradeep, learned Standing Counsel appearing for the respondents submitted that the mother of the petitioner had submitted an application as early as in the year 2016 seeking compassionate appointment for herself and accordingly, her case was considered and the name of the petitioner's mother was enrolled at serial No.481, in the list of candidates eligible for compassionate appointment and she would be provided with necessary appointment order, as and when application comes up for consideration.

6. Learned Standing Counsel contends that the question of considering the claim of the petitioner for compassionate appointment at this stage does not arise.

7. This Court carefully considered the submissions made on either side and also perused the entire material on records.

8. The fact remains that the father of the petitioner passed away while in service on 19.01.2014. Notwithstanding the claim made by the mother of the petitioner, the petitioner also made a claim for compassionate appointment by submitting representation dated 25.06.2025. Whether the petitioner is entitled to seek such compassionate appointment or not? cannot be adjudicated by this Court, at this stage, as the said issue has not been considered by the respondents and representation dated 25.06.2025 submitted by the petitioner is pending for consideration before the second respondent. 4/7

In the circumstances, this Court is of the considered view that it is not proper to go into the merits of the matter at this stage and of the considered view that it would be appropriate to dispose of the writ petition, by giving appropriate directions to respondents to consider and take a decision on the representation submitted by the petitioner.

Accordingly, writ petition is disposed of directing the second respondent to consider the representation dated 25.06.2025 submitted by the petitioner and pass appropriate orders as expeditiously as possible, at any rate, within a period of six (6) weeks from date of receipt of a copy of this order. No costs.
