Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus calling for the records relating to the proceedings of the first respondent Khadi Board order No.5, dated 25.4.2011 confirming the order dated 10.10.2002 passed by the second respondent in Na.Ka.No.55160/96/E4(1), and quash the same and consequently direct the respondents to pay all the pensionary and other retirement benefits to the petitioner with interest. [Order of the Court was made by M.M.SUNDRESH, J.] Heard Mr.G.Karnan, learned Counsel appearing for the appellants and Mr.S.Anwar Sammem, learned counsel appearing for the respondent.

2. The appeal is directed against the order passed by the learned Single Judge remitting the matter for fresh consideration to the appellants on the question of quantum of punishment alone. In other words, the charges as found were not disturbed by the learned Single Judge. The learned Single Judge took into the attending circumstances for coming to the conclusion. We do not find any illegality in the order passed by the learned Single Judge.

3.In such view of the matter, we are not inclined to interfere with the order passed by the learned Single Judge. Hence, the appeal is dismissed. No costs. Consequently, connected miscellaneous petition is also closed.
