To enlarge the petitioner on Interim bail in C.C No. 960 of 2023 in Crime No. 217/2023 for the period of 10 days pending on the file of the 2nd Additional Special Judge for NDPS Cases, Madurai Prayer in CRL OP(MD). 4351/ 2024 :

To enlarge the petitioner on Interim bail in C.C No. 959/2023 in Crime No. 81/2023 for the period of 10 days pending on the file of the Principal Special Judge for NDPS Cases, Madurai ORDER : The Court Made the following order :- The petitioner is facing charges under Sections 8(c),20(b)(ii)(C),25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.217 of 2023 and under Sections 8(c), 20(b)(ii)(c), 25, 29(1), 25(1)(a) of Narcotic and Substances Act in Crime No.81 of 2023 on the file of the respondent police. The earlier application came to be dismissed repeatedly, by considering the grievous nature of the allegations against him.

2. Now it is submitted by the learned counsel for the petitioner that the petitioner's father died on 16.03.2024 at 2.a.m., at Chennai Stanley Hospital. Now the cremation is over. On 21.03.2024, the other rituals are going to be conducted at Chennai. On that account, the petitioner seeks interim bail. 2/5

Considering this, learned Additional Public Prosecutor would submit that the petitioner will be taken from the Central Prison, Madurai to Central Prison, Puzhal on the evening of 20.03.2024 and on 21.03.2024, he will be taken to his father's house. After the rituals are over, he will be taken back to the Central Prison, Puzhal in the evening itself and the next day on 22.03.2024, he will be taken to the Central Prison, Madurai.

4. The above said submission of the learned Additional Public Prosecutor is placed on record. The cost of escort also be owned by the petitioner. With the above observation, there shall be an order of interim bail on custody to the petitioner on 21.03.2024, for one day. Accordingly, the petitioner is ordered to be released on interim bail, on executing own bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the satisfaction of the Superintendent, District Prison, Madurai. sd/- 18/03/2024 / TRUE COPY / 18/03/2024 Sub-Assistant Registrar (CS -II ) Madurai Bench of Madras High Court, Madurai - 625 023.
