PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the fourth respondent vide his proceedings nr.f.vz;.02/01/2026 dated 13.01.2026 and quash the same as illegal and consequently direct the respondents to reinstate the petitioner into service after revoking suspension. O R D E R

This writ petition has been filed challenging the impugned proceedings bearing nr.f.vz;.02/01/2026 dated 13.01.2026, whereby the petitioner was dismissed from service while he was working as a P.G. Assistant in the fourth respondent school. The main ground of challenge is that the impugned proceedings have been issued without following the procedure contemplated under Rule 29(1)(4) of the Tamil Nadu Private School Regulation Rules. It is further contended that no charge memo was issued to the petitioner, nor was any enquiry conducted prior to issuing the impugned proceedings.

2.On the other hand, Mr. V. Rajiv Rufus, learned counsel appearing for the fourth respondent, fairly submitted that the impugned proceedings cannot be sustained for want of compliance with the principles of natural justice and, therefore, requested that the matter be remanded to the fourth respondent for taking appropriate steps in accordance with law. 3.In the light of the above, without going into the merits of the matter, this Writ Petition is allowed and the impugned proceedings bearing nr.f.vz;. 02/01/2026 dated 13.01.2026 is hereby quashed, leaving it open to the fourth respondent to take appropriate action strictly in accordance with law. Consequently, the petitioner shall stand restored to the position which he held prior to the issuance of the impugned proceedings. No costs. Consequently, connected Miscellaneous Petition is closed.
