Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to renew the petitioner's Cable Registration Certificate No.886 by considering the petitioner's representations dated 20.09.2021 and 07.01.2022 within stipulated time. For Petitioner : Mr.I.Robert Chandrakumar For R-1 R-3 and R-4 : Mr.M.Lingadurai, Special Government Pleader.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the second respondent to renew the petitioner's cable registration certificate by considering the representations dated 20.09.2021 and 07.01.2022 within a time frame to be fixed by this Court.

2. According to the petitioner, his cable TV operator registration certificate No.886 which was earlier issued by the second respondent got expired on 18.09.2021. He has submitted two representations, one dated 20.09.2021 and the other dated 07.01.2022 seeking for renewal of his registration certificate. Since the said representations have not been considered till date, he has filed this Writ Petition.

Heard Mr.I.Robert Chandrakumar, learned counsel for the petitioner, Mr.M.Lingadurai, learned Special Government Pleader, who accepts notice on behalf of the respondents 1, 3 and 4 and Mr.V.Malaiyendran, learned Central Government Standing Counsel, who accepts notice on behalf of the respondents 2 and 5.

4. The petitioner has filed documents along with the Writ Petition including the registration certificate granted in his favour earlier by the second respondent, which got expired on 18.09.2021. The petitioner has also enclosed the representations given by him along with the Writ Petition seeking for renewal of his registration certificate.

5. Admittedly, the representations of the petitioner have not been considered till date. No prejudice would be caused to the respondents, if the petitioner's representations are considered on merits and in accordance with law, after affording a fair hearing to the petitioner including granting him the right of personal hearing.

In the result, this Court directs the second respondent to consider the petitioner's representations dated 20.09.2021 and 07.01.2022 seeking for renewal of his registration certificate bearing No.886 for a further period and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner including granting him the right of personal hearing within a period of twelve (12) weeks from the date of receipt of a copy of this order.

7. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
