O R D E R

This writ petition has been filed seeking a writ of Mandamus directing the respondents to provide employment to the petitioner with back wages, continuity of service and all other attendant benefits payable to him.

2. The case of the petitioner is that consequent to the registration of the criminal case against him in FIR No.34 of 2025 by Bodinayakanur Rural Police Station, the petitioner is not allowed by the respondents to attend duty as ATM in Bodinayakanur branch of the respondent Corporation.

3. The learned Standing Counsel for the respondent, on instructions, submits that after registration of criminal case against the petitioner and though he released on anticipatory bail, he was not attend the duty thereafter. The learned Standing Counsel submits that the respondent never stopped the petitioner to attend the duty.

4. On consideration of the submissions made by the respective learned counsels, it appears that as on date, the respondent did not pass any orders suspending the petitioner from service. Whether the petitioner is not attend the duty or the respondent is not allowing the petitioner to attend duty is to be decided later in appropriate proceedings.

5. In view of the above submissions, in my considered view, this writ petition can be disposed of at the admission stage with the consent of both parties by issuing certain directions to the petitioner and the respondent to meet the ends of justice.

6. Accordingly, this writ petition is disposed of with the following directions:

1. The petitioner shall approach the Bodinayakanur branch Manager of the respondent Corporation forthwith.

2. If the petitioner approach the Bodinayakanur branch Manager of the respondent Corporation, he should be allowed to attend the duty without any objections.

No costs.
