ORDER

This Writ Petition Criminal filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to take action on the petitioner's complaint dated 14.02.2026.

2. Learned counsel for the petitioner submitted that the petitioner had given a complaint dated 14.02.2026 as against one GopalaKrishnan and Vignesh who are running a clinic in the name and style as Josh Clinic, with respect to forgery of cheques under the Negotiable Instruments Act. Since no action has been taken, this writ petition is filed.

3. Learned Additional Public Prosecutor submitted that enquiry has been conducted on the complaint of the petitioner in CSR No.780 of 2025 and the same was closed on 02.09.2025, directing the parties to work out remedy before the competent civil Court. 2/4

4. Learned counsel for the petitioner submitted that the information given by the learned Additional Public Prosecutor is with respect to an earlier complaint and a new complaint has been given now for which, no action has been taken by the respondent police.

5. In reply, the learned Additional Public Prosecutor submitted that the new complaint has been given for the same cause of action for which enquiry is conducted and the same is closed.

6. Considering the submissions made by either side, this Court further directs the second respondent to consider the complaint made by the petitioner and take necessary action, in accordance with law.

7. With the above direction, this Writ Petition is disposed of. No costs.
