Respondent Prayer :- Criminal Original Petition filed under section 482 of Criminal Procedure Code to direct the VI Additional District court, Madurai to expedite the trial in S.C No. 281 of 2021 on the VI Additional District Court, Madurai. ORDER:- This Petition coming on for hearing on this day under the caption 'Extension of time for 'Lower Court' and upon perusing earlier order dated 12.04.2024 and the requisition submitted by the VI Additional District Judge (FAC), Madurai, in D.No.36 dated 23.01.2025, seeking further time to dispose of the case in 1/4
S.C.No.281/2021, this Court made the following Order: The learned VI Additional District Judge, Madurai by his letter dated 23.01.2025 has sought further time to dispose of the case in S.C. No. 281 of 2021
2. This Court had already directed the learned VI Additional District Judge, Madurai to dispose of the case in S.C. No. 281 of 2021 within a period of six months from the date of receipt of the order.. The learned Sessions Judge had stated that after receiving the copy of the order the case posted for trial on 12.08.2024. On 12.08.2024 proceedings were issued for L.W. 1 to L.W.4. On 23.09.2004,P.w.1 to P.W.9 were examined. On 30.09.2024 P.W. 10 examined and posted for continuation on 28.10.2024. On 28.10.2024 P.W.10 to P.W. 12 examined. On 04.11.2024 P.W.13 and P.W. 14 examined. On 25.11.2024, P.W.15 examined. On 16.12.2024, P.W. 16 examined and the case posted to 20.01.2025 for appearance of L.W. 17, L.W. 20 to L.W.24. Further the case is posted to 24.012025 for appearance of L.W.17,20 to 24.
He further submitted that apart from this case the High Court has also given direction of cases in O.S. No. 371 of 2022, O.S.No.99 of 2019,E.P.No.86 of 2022((NH) LAOP No.31 of 2009 and S.C.No.303 of 2020 and S.C. No.307 of 2019.
Court is also examining the witnesses on priority basis. He further stated that he has taken Full Additional Charge of the post of VI Additional District and Sessions Judge, Madurai in addition to the post of II Additional District Judge for CBI Cases, Madurai w.e.f 27.05.2024 to till date, thereby he is not in a position to dispose the case within the time stipulated by this Court.
3. Considering the request made by the learned VI Additional District Judge, Madurai and also considering the facts and circumstances of the case, time already granted by this Court to dispose the case in S.C.No.281 of 2021 is extended by another three months from the date of receipt of a copy of this order.
