ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for suspension of sentence imposed on the petitioner in the judgment made in S.C.No.267 of 2019 dated 10.12.2025 on the file of the learned District and Sessions Judge, Fast Track Court, Tenkasi, Tenkasi District and to enlarge the petitioner on bail.

2. The case of the prosecution is that the accused married the deceased on 04.09.2010. Many a times, the deceased and his wife used to quarrel, since the accused has drinking habit and in an inebriated condition, he used to quarrel with the deceased. On the date of incident, the accused person is said to have assaulted the deceased, pushed her down and strangulated her neck with a rope which caused the death of the deceased. Based on the same, an FIR came to be registered in Crime No.92 of 2018 by the respondent Police.

The trial Court, on considering the facts and circumstances of the case and on appreciation of oral and documentary evidence, came to a conclusion that the prosecution has proved the case beyond reasonable doubts and accordingly, convicted the petitioner for the offence under Section 302 of IPC and sentenced him to undergo life imprisonment and to pay a fine of Rs.10,000/- in default to undergo one year simple imprisonment. Aggrieved by the same, the present petition has been filed.

4. Heard the learned counsel on either side.

5. On carefully considering the materials placed before this Court and the judgment rendered by the trial Court, it is seen that the deceased and the accused person had regular quarrels. Even on the date of occurrence, there was a quarrel between the deceased and the accused person and the accused is said to have pushed down the deceased and strangulated her with a rope. The accused person has entered the witness box and was examined as D.W.1 and he has given a version to the effect that the deceased was mentally depressed and she had suicidal intention and therefore, she had strangulated herself.

In the considered view of this Court, taking note of the evidence that has been let in by the prosecution, it has to be seen as to whether the version given by the petitioner is acceptable or in the event, the prosecution has made out a case, it has to be seen whether the case in hand will fall under any of the exceptions to Section 300 of IPC. The petitioner is suffering incarceration from 10.12.2025 and there are no previous antecedents against the petitioner. It will take some more time to hear the appeal finally on merits.

7. In view of the same, we are inclined to suspend the sentence imposed on the petitioner and accordingly, the Criminal Miscellaneous Petition is allowed, subject to the following conditions: i. The petitioner is directed to be enlarged on bail on executing a bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Tenkasi.

ii. The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank passbook to ensure their identity. iii. The petitioner shall appear and sign before the trial Court every Monday at 10.30 a.m., until further orders. (N.ANAND VENKATESH J.)
