Respondent PRAYER: Petition filed under Section 439(1)(b) of the Code of Criminal Procedure, to modify the condition imposed by the learned Judicial Magistrate, Nanguneri in Crl.M.P.No.7392 of 2016 dated 14.09.2016 and modify the condition as to direct the petitioner to appear before the learned Judicial Magistrate No.I, Tirunelveli at 10.30 a.m instead of appearing before the respondent Police daily at 10.30 a.m for four weeks and 1st working day of every month till filing of the charge sheet until further orders.

The learned counsel for the petitioner submitted that the condition imposed by the learned Judicial Magistrate to the effect that the petitioner shall appear before the learned Judicial Magistrate may be modified and the petitioner may be directed to appear before the respondent Police.

2.Heard the learned Government Advocate (Crl.Side), who would submit that the petitioner is complying with the condition imposed by the learned Judicial Magistrate, Nanguneri, in Cr.M.P.No.7392 of 2016, dated 14.09.2016 only from 22.09.2016 to 28.09.2016. 3.Considering the above submission made by the learned Government Advocate (Crl.Side), this petition is dismissed. The petitioner is directed to comply with the condition already imposed by the trial court until further orders.
