This Writ Petition has been filed seeking a direction to the second respondent to delete the name of the petitioner from the history sheet in 244 of 2023 on the file of the second respondent. 2.The learned Counsel for the petitioner would submit that the Inspector of Police, S.S.Colony Police Station, Madurai registered a case against the petitioner in Crime No.60 of 2021 for the offences under Sections 8c, 20(b)(ii)(c), 29(i) and 25(ii) of NDPS Act and thereafter, the second respondent has opened a history sheet in the petitioner's name in H.S.No.244 of 2023 without any reasons. Therefore, the petitioner sent the representation dated 22.02.2025 seeking to remove his name from the history sheet, but the same has not been considered. Hence this petition. 3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner has three previous cases and two cases were already disposed of by acquitting the accused and now an FIR in Crime No. 13 of 2021 is pending and therefore, the 2/5
respondent police have opened the history sheet in H.S.No.2 of 2025. The petitioner is a habitual offender and thereby, they opened the history sheet. However, the petitioner sent the representation dated 22.02.2025 seeking to remove his name from the history sheet and the same is under consideration. After enquiry, appropriate steps will be taken in accordance with law.
4.Since the prayer of the petitioner is to remove his name from the history sheet, to that effect he also sent a representation to the first respondent on 22.01.2025 and the same is also under consideration, the first respondent is directed to consider the petitioner's representation, dated 22.02.2025 and pass orders, within a period of fifteen days, from the date of receipt of a copy of this order, in accordance with law. 5.With the above direction, this writ petition is disposed of. 14.03.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR 3/5
