Respondent/Respondent PRAYER :- Criminal Miscellaneous Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, to modify the condition order dated 03.02.2026 Page No.4 Para 6 (b) the petitioner shall stay in Chennai Egmore and report before the D1 Triplicane Police Station, Walajah Salai, Triplicane, Chennai - 600 005 daily at 10.30 a.m., until further orders instead of (b) the petitioner shall stay in Madurai and report before the Tallakulam Police Station daily at 10.30 a.m, until further orders in Crl.O.P(MD) No.1104 of 2026.

Mr.M.Karunanithi Government Advocate (Criminal Side) ORDER : The Court made the following order :- This petition has been filed to to modify the condition order dated 03.02.2026 Page No.4 Para 6 (b) the petitioner shall stay in Chennai Egmore and report before the D1 Triplicane Police Station, Walajah Salai, Triplicane, Chennai - 600 005 daily at 10.30 a.m., until further orders instead of (b) the petitioner shall stay in Madurai and report before the Tallakulam Police Station daily at 10.30 a.m, until further orders in Crl.O.P(MD) No.1104 of 2026.

2. The learned counsel for the petitioner submitted that the petitioner is suffering from a heart ailment and seeks to undergo treatment in Chennai; accordingly, he prays for modification of the said condition.

The learned Government Advocate (Criminal Side) appearing for the respondent opposed the said petition stating that the petitioner committed offence under the POCSO Act and also now the final report has been filed and the same was taken on file in Spl.S.C.No.63 of 2026 on the file of the Special Court for Exclusive Trial POCSO Act Cases, Thoothukudi. 2/5

4. This Court has considered the rival submissions and perused the records.

5. It is undisputed that the victim is also residing at Tallakulam, as rightly submitted by the learned counsel for the petitioner. This Court has also taken into consideration the health condition of the petitioner; therefore, the condition imposed earlier is modified as follows:

Considering the nature of offence, the condition imposed by this Court in Crl.OP(MD).No.1104 of 2026 dated 03.02.2026, is modified and the petitioner shall report before the Special Court for Exclusive Trial POCSO Act Cases, Thoothukudi, once in a month ie., on first working day of every month at 10.30 a.m., until further orders, apart from that on all regular hearing dates appear before the concerned Court without fail. Accordingly, this Criminal Miscellaneous Petition is allowed.
