O R D E R

This Criminal Original Petition is filed for a direction to the learned Judicial Magistrate No.I, Fast Track Court at Magistrate Level, Madurai to dispose of the case in S.T.C.No.1051 of 2013.

2.Heard the learned Counsel for the petitioner.

3. The learned Counsel appearing for the petitioner would submit that the petitioner filed a private complaint against the respondent under Section 138 of Negotiable Instruments Act. The evidence of the complainant was over on 08.08.2016 and after 313 Cr.P.C. questioning, the case is now posted for defence evidence. It is further submitted that the accused is not at all appearing before the trial Court and he has been seeking adjournment without any valid reasons, which causes mental agony and hardship to the petitioner.

4. Considering the facts and circumstances of the case, without going into the merits of the case, the learned Judicial Magistrate No.I, Fast Track Court at Magistrate Level, Madurai is directed to dispose of the case in S.T.C.No.1051 of 2013 on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/

5. With the above directions, this Criminal Original Petition is disposed of.
