PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 2nd respondent to consider and dispose the appeal filed by the petitioner in file No.562/2026 and to cancel the patta transferred in the name of the 4th respondent in patta No.8679 and to retransfer the same to its original position i.e. patta No.1576 in the name of the petitioner, within the time limit fixed by this Court. O R D E R

This petition has been filed seeking to direct the 2nd respondent to consider and dispose the appeal filed by the petitioner in file No.562/2026 and to cancel the patta transferred in the name of the 4th respondent in patta No.8679 and to retransfer the same to its original position i.e. patta No.1576 in the name of the petitioner, within the time limit fixed by this Court.

2. The learned counsel for the petitioner submitted that the third respondent illegally issued patta in favour of the fourth respondent. It was further 2/5

stated that the patta originally stood in the name of the petitioner but was subsequently cancelled, and a new patta was issued to the fourth respondent. The petitioner contends that no notice or information was provided to them prior to such cancellation. Aggrieved over the same, the petitioner has preferred an appeal before the second respondent.

3. The learned Government Advocate appearing for respondents 1 to 3 submitted that the appeal has been taken on file as No. 562 of 2026 and that notice has already been issued to the fourth respondent.

Considering the facts and circumstances of the case, this Court directs the petitioner to submit the grounds of appeal before the second respondent within a period of one week from the date of receipt of a copy of this order. Upon such submission, the second respondent shall consider the appeal and pass appropriate orders on merits and in accordance with law within a period of twelve weeks thereafter.
