For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.947 of 2020 in the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323 and 506 (i) of I.P.C., r/w Section 4 of Women Harassment Act in Crime No. 947 of 2020 on the file of the respondent police, seek anticipatory bail.

3.The petitioner's earlier petitions suffered dismissal. 4.The learned counsel appearing for the petitioners states that the petitioners undertake to remit a sum of Rs.5,000/- (Rupees

Five Thousand only) in the bank account of the de facto complainant every month towards maintenance.

5.In view of the above submission, the petitioners are directed to deposit a sum of Rs.5,000/- (Rupees Five Thousand only) to the bank account of the de facto complainant towards maintenance from the next month onwards. This of course is only the interim arrangement and the rights of the parties will be decided in the pending matrimonial proceedings. The liability of the petitioners will commence from the next month onwards. 6.Subject to this condition, I am inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Vadipatti, Madurai and on their executing a bond for a sum of Rs.

10,000/- (Rupees Ten thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously. 7.The petitioners shall appear before the concerned Magistrate within a period of eight weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
