ORDER
Challenging the order passed by the learned Vacation Sessions Judge, Kanniyakumari District at Nagercoil, dated 24.02.2026 in Crl MP No.630 of 2026 and relax the condition imposed upon the petitioner by the learned Principal Sessions Judge, Kanyakumari at Nagercoil in Crl.MP.No.1443 of 2021 dated 20.03.2021, this Criminal Revision case has been filed.

The petitioner is the owner of the Mahindra & Mahindra Tipper vehicle bearing Registration No.TN75 B 5369, and has filed a petition under Section 451 of Cr.P.C., 1973, before the learned Principal Sessions Judge, Kanyakumari at Nagercoil in Crl.MP.No. 1443 of 2021, seeking interim custody of the vehicle. The learned Judicial Magistrate, after hearing both sides, allowed the petition and granted interim custody of the vehicle to the petitioner on certain conditions, including the condition that the petitioner shall produce the vehicle before the learned Judicial Magistrate Court No.III, Nagercoil, on the first working day of every month. 2/5

Challenging the same, the petitioner has preferred Crl.M.P.No.630 of 2026 on the file of the learned Vacation Sessions Judge, Kanniyakumari District, to relax the condition imposed against the petitioner's vehicle bearing Regn. No.TN 75 B 5369. However, the same was dismissed by an order dated 24.02.2026. Challenging the same, the petitioner is before this Court.
4. The learned counsel for the petitioner submitted that the petitioner has complied with the conditions imposed by the learned Principal Sessions Judge, Kanyakumari at Nagercoil in Crl.MP.No. 1443 of 2021, from the year 2021, and hence, he sought for relaxation of such conditions.

Considering the facts and circumstances of the case, and also considering the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the condition No.vii of the order passed by the learned Principal Sessions Judge, Kanyakumari at Nagercoil in Crl.MP.No.1443 of 2021 dated 20.03.202.

6. Accordingly, this Criminal Revision Case is partly allowed, and the condition No.vii imposed by the learned Trial Court is hereby set aside, and the petitioner is directed to produce the vehicle before the learned Principal Sessions Judge, Kanyakumari at Nagercoil, once in six months.
7. All other conditions imposed by the learned Trial Court shall remain unaltered. No costs.
