O R D E R

The present Civil Revision Petition has been filed challenging the return of the review application filed on 18.02.2025 seeking to review the order dated 30.12.2024, passed in C.C.No.1 of 2024.

2. A perusal of the return order shows that Section 40 of the Consumer Protection Act, has been extracted and it is stated that there is no error apparent on the face of the record, for entertaining a Review Application. Challenging the said order, the present Civil Revision Petition has been filed.

3. According to the learned counsel appearing for the revision petitioner, the free order copy was received by hand on 30.01.2025 and Review Application has been filed within a period of 30 days, ie., on 18.02.2025. Whether there is an error apparent on the face of the record or not can be decided by the concerned Court, after hearing the review applicant. Therefore, the return order impugned in the Revision Petition is hereby set aside and the District Consumer Disputes Redressal Commission, Thanjavur, is directed to number the Review Application, if it is otherwise in order, and 2/4

proceed to pass orders on merits and in accordance with law, after giving due opportunity to the revision petitioner.

4. With the above said observation, this Civil Revision Petition is disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.

5. The Registry is directed to return the original impugned order after getting necessary acknowledgment from the learned counsel appearing for the revision petitioner.
