PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to direct the Learned Judicial Magistrate No. VI, Madurai to dispose the C.C. No. 2364 of 2024, pending on his file within stipulated time may be fixed by this Court.

ORDER

The present petition has been filed seeking a direction to the learned Judicial Magistrate No.VI, Madurai, to dispose of C.C.No.2364 of 2024, wherein the accused persons have been charged with the offences under Sections 296(b), 115(2), 329(4), 133, 303(2) and 351(2) of BNS, 2023.

2. According to the learned Counsel appearing for the petitioner, so far the prosecution has not marshalled their witnesses and only now summons have been issued to the witnesses to appear before the Court on 21.05.2026.

3. Considering the fact that it relates to a custody of child and therefore, a direction is issued to the learned Judicial Magistrate No.VI, Madurai, to dispose of the case as expeditiously as possible.

4. With the above said observations, this Criminal Original Petition stands disposed of.
