Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) of IPC, in Crime No.138 of 2016, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that due to wordy quarrel, the petitioners and other accused attacked the defacto complainant and also abused with filthy language.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and their names have been falsely implicated in this case.

4. The learned Government Advocate (criminal side) submitted that A1 to A8 are before this Court and except one, other victims have discharged from the hospital and one person is taking treatment for a fracture in hand. learned counsel for the petitioners submitted that the said fractured suffered by a person not related to the alleged occurrence.

5.Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners with the following condition. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Aruppukkottai, Virudhunagar District, within a period of 10 days from the date on which the order copy made ready, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the jurisdictional Court daily at 10 a.m. until further orders. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
