Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as Accused Nos.1 to 4, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294(b), 506(i) and 109 IPC, in Crime No. 588 of 2016, on the file of the respondent police, seek anticipatory bail.

2. The Case of the prosecution is that the petitioners attacked the defacto complainant on 14.08.2016, while he was clearing the thorny bushes before his ancestral house at Srirangam.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He further submitted that this is a case in counter case.

4. The learned Government Advocate (Criminal Side) submitted that this is a case in counter case and the counter case has been registered in Cr.No.596 of 2016 and no one was injured in both the cases.

5.Considering the facts and circumstances of the case and also considering the fact that no one was injured in this case, I am inclined to grant anticipatory bail to the petitioners with the following condition. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.III, Trichy, within a period of 10 days from the date on which the order copy made ready, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
