This petition has been filed under Section 482 Cr.P.C, to call for the records pertaining to the judgment in Cr.M.P.No.4376 of 2016 dated 16.09.2016 in C.C.No.175 of 2009 on the file of the Judicial Magistrate No.III, Nagercoil in Crime No.105 of 2009, on the file of the Respondent No.1 and set aside the same.

3.The learned counsel for the petitioner would submit that against the order passed in the petitions under Sections 91 of Cr.P.C., and 311 of Cr.P.C., dated 16.09.2016, the petitioner has filed this petition before this Court on 22.09.2016. Though, the petitioner has filed a memo before the trial court on 29.09.2016 stating about the pendency of this case, it was ended an acquittal on 29.09.2016.

4.The learned Government Advocate (Crl.side) would submit that since there is not stay in this petition, the learned Trial Judge has delivered Judgment in C.C.No.175 of 2009, on 29.09.2016.
