Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No.59 of 2024 on the file of the respondent Police. ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 11.03.2025 under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant an order of bail.
2. Today, when the matter is taken up for hearing, the learned Government 1/3
Advocate (Crl. Side), on instructions, submits that the respondent-Police initially registered a case under Section 87 of Bharatiya Nyaya Sanhita, 2023 and Sections 5 (l), 5(m) and 6 of Prevention Of Children from Sexual Offences Act, 2012 in Crime No.59 of 2024 on the file of the respondent-Police. He further submits that during investigation, the Investigation Agency altered the charges vide alteration report dated 20.01.2025 and included the offence punishable under Section 3(1)(w)(i) of the Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. In view of the Section 14 of Scheduled Casts and Schedules Tribes (Prevention of Atrocities) Act, only an appeal would lie.
3. This Court has perused the bail order dated 20.02.2025 passed by the Trial Court in Crl.M.P.No.169 of 2025. The prosecution agency did not say anything about the alteration report dated 20.01.2025.
4. In view of the above, Mr.Imran Khan.J, learned counsel for the petitioner seeks permission of this Court to withdraw this petition. To that effect, he has made an endorsement in the case file and the same is extracted hereunder; "u/s is alter. withdraw with liberty"

3. In view of the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn and liberty is granted to the petitioner to file a fresh application before the Special Court for Exclusive Trial of POCSO Act Cases, Madurai as per law.
