For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioner on bail in the event of his arrest by the Respondent Police in Cr.No. 442 of 2020 on the file of the Inspector of Police, Jeyamangalam Police Station, Theni District. ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 8(c) r/w 20(b)(ii)(B) of NDPS Act,1985, in Crime No. 442 of 2020 on the file of the respondent police, seeks anticipatory bail.

3. The case of the prosecution is that on 01.06.2020, based on the secret information, the respondent police went to the occurrence spot of A.Vadipatti check post and when there were checking the vehicle, the accused nos.1 and 2 were riding a motor bike and they https://hcservices.ecourts.gov.in/hcservices/

CRL OP(MD). No.6089 of 2020 were stopped by the police and upon searching their gunny bags, it was found that they had possessed and transported 6 kilograms of ganja without any valid permission.

4. The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution and he is an innocent and he has been falsely implicated in the above said case.

5. The learned Additional Public Prosecutor appearing for the State would submit that the ganja weighing about 6 kg has been seized from the accused Nos.1, 2, 3 and 4 and the co-accused has also furnished the confession statement. He would further submit that some previous cases similar in nature are pending against the petitioner and the investigation is still going on.

6. Considering the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail.
