PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to transfer the investigation pertaining to the case in Crime No. 200 of 2021 on the file of the second respondent to third respondent Police.

2. The case of the petitioner is that the petitioner is a First Class Government Contractor and also former Village President. The petitioner has earned good will among the villagers in that area. The Public Works Department has recently given a Work Order for constructing hostel building for BC College at Maruthankanviduthi in Karambakudi Taluk. The value of the project is Rs.1,99,00,000/-. The petitioner has withdrawn sum of Rs.6,00,000/- on 16.10.2021 through the Cheque No.287961 from the State Bank of India, Pudukottai Branch. The petitioner after withdrawing the said amount has left the Bank in his four-wheeler bearing Registration No.TN 55 BE 6363 at about 04.30 P.M.

, and when he reached the Agni river bridge, one Shanmugam along with some other persons intercepted the vehicle of the petitioner and suddenly, the said Shamugam has robed the above said amount from the petitioner and attacked the petitioner and escaped from that place. Due to which, the petitioner sustained injuries and thereafter, the petitioner went to the Pudukottai Government Hospital and took treatment. The Sub Inspector of Police, Sampattividuthi Police Station has obtained a statement from the petitioner with regard to the above said occurrence. In pursuance of the statement obtained from the petitioner, the second Police has registered a case in Crime No.200 of 2021 for the offence punishable under Sections 147, 323 and 379 IPC.

3. The learned counsel appearing for the petitioner would submit that though the respondent Police has registered a case in Crime No.200 of 2021 against the accused persons, the same was not properly investigated.

4. The learned Additional Public Prosecutor would submit that the Investigating Officer is not available now and after joining of the new officer, the investigation will be conducted.

5. Considering the submissions made by learned counsels on either side, this Court directs the second respondent to complete the investigation in Crime No.200 of 2021 within a period of six weeks from the date of receipt of a copy of this order.

6. Accordingly, the Criminal Original Petition stands disposed of.
