Prayer: Petition filed under Section 482 of the Criminal Procedure Code, to direct the Respondent No.1, to withdraw the petitioner's complaint, dated 24.05.2020 in C.S.R.No.93 of 2020 pending before the Respondent No.2 and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation of the case based on the representation, dated 02.06.2020. ORDER

This petition is filed for a direction for issuance of direction to direct the respondents to withdraw his complaint, dated 24.05.2020 in CSR No.93 of 2020 on the file of the respondent Police and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation. 2.The learned counsel appearing for the petitioner submits that the respondent Police colluding with the accused, has not taken action on his complaint lodged before him on 24.05.2020. 3.The learned Additional Public Prosecutor, on instructions, submits that the complaint received from the petitioner was treated as petition enquiry in C.S.R.No.93 of 2020 and after enquiry it was found that it is civil in nature. By recording the same, it was closed on 29.05.2020 by advising the parties to approach the civil Court.
