ORDER

This Contempt Petition has been filed seeking orders to punish the contemnor/respondent for his willful and deliberate disobedience of the order of this Court passed in W.P(MD)No.7725 of 2021, dated 27.06.2024. 1/4

2. When the matter is taken up for hearing today (ie., 27.03.2026), the learned counsel appearing for the respondent/Commissioner would submit that the petitioner has not filed any affidavit as directed by this Court and after filing the present contempt petition, they have sent a letter.

3. The learned counsel appearing for the petitioner would submit that the suit in O.S.No.572 of 2017 was dismissed on 16.09.2025, but an appeal in A.S.No.71 of 2025, is now pending on the file of the I Additional District Court, Tuticorin.

4. It is pertinent to note that in the writ order, this Court, considering the submissions made on either side, has observed that "the first respondent has to be directed to receive the property tax, subject to the condition that after filing an affidavit by the writ petitioner that they will not claim any, based on the receipt of such tax by the first respondent." 5.As already observed, the entire dispute is now subject to the result of the appeal, ie., pending before the competent Civil Court. 6.Considering the submission made on either sides, the Writ Petitioner is directed to file an affidavit before the first respondent within a period of 10 2/4

days from the date of receipt of copy of this order and on receipt of the same, the first respondent is directed to restore the assessment and receive the tax subject to the result of the appeal in A.S.No.71 of 2025.
