ORDER

This writ petition has been filed to issue a Writ of Mandamus to consider the representation of the petitioner dated 13.01.2026 and transfer him to any central prisons (or) Sub Jails at Virudhungar, Thirumangalam, Tenkasi within the jurisdiction of second respondent.

2. Heard the learned counsel for petitioner and Mr.Om Prakash, learned Government Advocate appearing for the respondents.

3. By consent of the parties, this writ petition is taken up for final disposal at the admission stage itself.

4. The petitioner herein, who was initially appointed as Grade II Warder on 25/3/1998, was subsequently promoted from time to time and finally to the post of the Chief Head Warder in the year 2017. While so, he was subjected to disciplinary proceedings and a charge memo was issued in the year 2021 while placing him under suspension. Subsequently, the said suspension was revoked on 28/12/2021. While so, 2/6

the petitioner claimed to have submitted a representation dated 13.01.2026 before the first respondent requesting to transfer him to any Central Prisons or Sub Jails at Virudhunagar, Thirumangalam, Tenkasi, within the jurisdiction of the second respondent. However, according to the learned counsel for the petitioner, the said representation is still pending for consideration.

5. The petitioner also contended that the respondents have considered the similar request made by several other candidates but the request for the petitioner is not being considered . In the said circumstances, this Court required the petitioner to produce any such orders passed by the respondents considering the request for transfer. Accordingly, the learned counsel for the petitioner placed before this Court the copies of the proceeding No.2437/Po.1/2026 dated 14.02.2026 and 12.03.2026, whereby the request for transfers of the respective candidates have been considered by the respondents.

6. Taking note of the same, Mr.Omprakash, learned Government 3/6

Advocate, fairly submitted that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner.

7. In the light of the above, without going into merits of the matter, this writ petition is disposed of directing the second respondent to consider the representation dated 13.01.2026 submitted by the petitioner on its own merits and pass appropriate orders thereon as expeditiously as possible at any rate within a period of two months from the date of receipt of a copy of this order. No costs.
