ORDER : The Court Made the following order :- The petitioner/accused No.2, who was arrested and remanded to judicial custody on 29.04.2017 for the offences punishable under Sections 294(b), 323, 324 and 307 I.P.C., in Crime No.69 of 2017 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 29.04.2017, the petitioner along with other accused attacked the defacto complainant with aruval and caused injuries.

3.The learned counsel for the petitioner would submit that the injured has been treated as out patient and he sustained only simple injury and he would further submit that the trial Court has not considered the same and dismissed the bail application. 4.The learned Government Advocate (Criminal Side) would submit that though they applied for discharge summary, they did not receive the same. She would further submit that the petitioner himself has admitted that the defacto complainant has sustained injury and the investigation is in preliminary stage.

5.Considering the nature of the offence and also considering the fact that the investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
