PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents more particularly the first respondent to consider the petitioner's representations dated 24.01.2025, 05.02.2025 an d 12.02.2025 with regard to misappropriation of 1/4

public funds and resources by the fifth respondent in the Sentha Mangalam Majara Village Panchayat and also to conduct a thorough and impartial investigation into the allegations of misappropriation and pass appropriate and suitable orders thereupon on merits and in accordance with law within a time frame as specified by this Court forthwith.

ORDER

(Order of the Court was made by J.NISHA BANU, J.) Heard Mr.Mr.J.Jeevan, learned counsel appearing for the petitioner, and Mr.P.Thilak Kumar, learned Government Pleader for respondents 1 to 4. Considering the nature of the order proposed to be passed in this writ petition, notice to the fifth respondent is dispensed with. 2.By consent, this writ petition is taken up for final disposal at the stage of admission itself.

3.This writ petition is filed to direct the first respondent to conduct investigation with regard to the misappropriation of public funds made by the fifth respondent in Senthamangalam Majara Village Panchayat and pass necessary orders by considering the representations submitted by the petitioner on various dates.

4.It is seen from the records that for the very same relief sought by the petitioner herein another writ petition filed by a ward member is pending before this Court in W.P.(MD)No.9807 of 2022.

5.When the writ petition filed by an another person for the very same relief is pending before this Court, the petitioner cannot maintain one another writ petition for the same cause of action. Accordingly, this writ petition is dismissed as not maintainable. No costs.
