Respondent Prayer: Petition is filed under Section 482 of Cr.P.C., for issuance of direction directing the Learned Judicial Magistrate, Lalgudi to dispose the C.C.No.28/2008 in Crime No.314 of 2006 on the file of the respondent herein to dispose the same within a stipulated time as fixed by this Honourable Court. O R D E R

This petition is filed for a direction to the learned Judicial Magistrate, Lalgudi for speedy disposal of C.C.No.28/2008 within a time frame.

2.Mr.V.Illanchezian, learned counsel for the petitioner submitted that the petitioners have been implicated in Cr.No.314 of 2006 on the file of the first respondent for offences under Sections 294(b), 352 and 506(ii) I.P.C and the delay in disposal of this case causes mental agony and hardship to the petitioners. 3.The learned Government Advocate (Crl.Side) appearing for the first respondent submitted that after investigation, in this case, charge sheet has been filed and taken on file in C.C.No.28 of 2008 and the petitioners have been regularly appearing before the trial Court. It was further submitted that on 07.06.2016, the learned Judicial Magistrate issued summons to the witnesses and though the summons was served on L.W.1, he was not present for the hearing on 21.06.2016, hence, a bailable warrant was issued and due to nonexecution of the warrant, the case is being adjourned. https://hcservices.ecourts.gov.in/hcservices/ 4.Considering the above submissions and the facts of this

case, the learned Judicial Magistrate, Lalgudi is directed to dispose of C.C.No.28 of 2008 as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order. Accordingly, this Criminal Original Petition is disposed of.
