This Writ Petition has been filed seeking a direction to transfer the complaint of the petitioner dated 12.09.2024 from the file of the third respondent to the respondents 1 and 2 or any other independent investigate agency and to take appropriate action against the respondents 4 to 7 and to further issue a direction to the respondents 1 and 2 to recover the properties owned by the sixth and seventh respondents in Plot No. 426a, 426b, 426c and 426d, Neidhal Block, Wisdom City, Annex Phase 7, Virudhunagar and 213a and 213b, Jayam Block Wisdom City, Annex Phase 7, Virudhunagar and E Block, Garlando City Kovilpatti.
2.The learned Counsel for the petitioner would submit that the petitioner is one of the depositors in the Neo Max Properties Private Limited, Madurai and she invested a sum of Rs.10,50,000/- on 3/7
08.06.2019 and she monthly received a sum of Rs.15,750/- for 48 months and again on 07.04.2021, she invested a sum of Rs.6,00,000/- to M/s. Transco Properties Private Limited, Tirunelveli and she received a sum of Rs.9,000/- per month as interest for 24 months. Thereafter, the petitioner came to know that the respondents 4 and 5 along with the Directors of the sixth and seventh respondents companies had deceived multiple investors and collected substantial amount on false promise and failed to return the amount. Through the above said investments the properties in Plot Nos. 426a, 426b, 426c and 426d, Neidhal Block, Wisdom City, Annex Phase 7, Virudhunagar and 213a and 213b, Jayam Block Wisdom City, Annex Phase 7, Virudhunagar and E Block, Garlando City Kovilpatti, had been purchased by the above company.
When they approached the fourth and fifth respondents, they have not repaid the amount, thereby, the petitioner lodged a complaint on 12.09.2024 to the third respondent but no action was taken. Again, she sent the representation dated 02.12.2024, to the first and second respondents, but the same has not been considered. Hence this petition. 3.
against the Neo Max Properties Private Limited and its sister concerns in Crime No.3 of 2023 and the same is pending. Thereafter, they frequently received complaints from the depositors. In this case around 1800 crores involved and already the investigation agency attached the properties of the above said company worth about a sum of Rs.212 crores and now the petitioner sent the representation and the same is under consideration and further action will be taken as against the properties mentioned in the petition.
4.Since the prayer of the petitioner is to transfer the complaint and already a case has been registered against the companies and its Directors and the same is under investigation, the third respondent also received more than 13478 complaints and already some of the properties were also attached and the matter is under investigation, it is for the third respondent to consider the petitioner's representation and take appropriate action in respect of the properties, after due enquiry. Therefore, the third respondent is directed to consider the petitioner's representation and take appropriate action within a period of two months from the date of this order in accordance with law. 5/7
