Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 341,427, 294(b) and 506(i) of IPC in Crime No.117 of 2017 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to land dispute, the petitioner along with other accused attacked the de facto complainant and also abused him in filthy language.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) would submit https://hcservices.ecourts.gov.in/hcservices/ that the occurrence took place on 28.01.2017, but, the FIR has been

registered only on 11.04.2017 and the investigation of the case is pending.

5. Considering the facts and circumstances of the case, this Court is of the view that there is no urgency for taking this matter in the Vacation Court and hence, this Criminal Petition is dismissed with liberty to file a fresh petition in the Regular Court.
