ORDER : The Court Made the following order :- The petitioners/ A2 & A3 apprehending arrest at the hands of the respondent police for the alleged offences under Sections 147, 294(b), 498(A) and 307 of I.P.C., r/w Section 4 of the Dowry Prohibition Act for the alleged occurrence said to have taken place on 08.12.2017, seeks anticipatory bail.

2.The learned counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. 3.Learned Additional Public Prosecutor submitted that the defacto complainant/Accused-1 and his wife had a wordy quarrel and in order to threaten the 1st accused, she lit fire on her nighty and seeing the same, Accused No.1 with an intention to save the life of his wife took her to the Government Hospital in Sivagangai from Kalaiyarkovil and a case was originally registered under Section 307 and later, during the course of treatment, she lost her life and it was then, altered to 302 IPC along with other offences. In this regard, it is also submitted that the investigation is still pending.

4.Considering the facts and circumstances of the case, this Court is inclined to grant the relief of anticipatory bail to the petitioners.

5.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Court No.1, Sivagangai District, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation.
