Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences under Section 392 IPC, in Crime No.322 of 2017 and seeks anticipatory bail.
2.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 3.The learned Additional Public Prosecutor submitted that four unknown persons waylaid the defacto complainant and snatched the gold chain. He further submitted that the property has been now recovered.
4.Considering the facts and circumstances of the case and also considering the fact the property has been recovered, this Court is inclined to grant the relief of anticipatory bail to the petitioner. 5.Accordingly, the petitioner is ordered to be released on bail https://hcservices.ecourts.gov.in/hcservices/
in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Nagercoil, Kanyakumari District or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation.
