Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the Petitioner on bail in the event of her arrest in connection with Cr.No.Not known of 2020 on the file of the Respondent Police and pass such further or other orders as this Honble Court.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 323 and 506(1) of I.P.C. and section 4 of TNPHW Act in Crime No.Not known of 2020 on the file of the respondent police, seek/s anticipatory bail.
3. The defacto complainant is wife of A1. A1 is said to have illicit intimacy with this petitioner.
4. Arrest of the petitioner is not going to serve any purpose. Hence, I am inclined to grant anticipatory bail to the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD. No.6006 of 2020 with certain conditions. Accordingly, petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned The Judicial Magistrate, Thiruppuvanam, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
