Prayer: Petition filed under Section 482 of the Criminal Procedure Code, to direct the first and second respondents herein to secure the detenue namely Divya Bharathi, aged about 21 years, W/o.Jegannathan, who is under illegal detention of 3rd respondent herein and before this Court and set her at liberty. ORDER

This petition is filed to direct the first and second respondents herein to secure the detenue namely Divya Bharathi, aged about 21 years, W/o.Jegannathan, who is under illegal detention of 3rd respondent herein and produce her before this Court and set her at liberty.

2.The alleged detenue namely Divya Bharathi is a B.Sc., graduate, aged about 23 years old and her father has lodged a complaint that she was missing. Based on the complaint lodged by her father, the respondent police secured her, however, she expressed that she is not willing to reside with her parents and that on her own accord, she has left her parental house. She has also requested the Officer of the Police station to refer her to any of the Home at Trichy for her safe custody. Only on her request, in writing, she was referred to a Home at Trichy and the learned Additional Public Prosecutor has also produced the letter of the alleged detenue, dated 25.05.2020.

Crl.O.P(MD)No.5998 of 2020 3.The petitioner, who is a distant relative to the alleged detenue has no locus to file this petition, when the so called detenue herself has requested to refer her to a Home at Trichy, instead of going with her parents.

4.In such view of the matter, this Criminal Original Petition is dismissed, as no further order is required to be passed.
