PRAYER :- For Bail in Crime No.399 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner /Accused who was arrested and remanded to judicial custody on 13.10.2021 for the offences under sections 302,109,120B,341,148 and 212 of IPC in Crime No.399 of 2021 on the file of the respondent police seeks bail.

2. It is seen that the petitioner sofar involved in 24 cases out of which ten cases pending trial. Out of the ten cases the petitioner involved in five 302 cases and the trial is going on. In the present case prosecution has so far examined 32 witnesses. Further this Court has already directed the trial Court to complete the trial as expeditiously as possible preferably within a period of three months from the date of receipt of copy of the order.

3. The learned counsel for the petitioner would submit that similar placed co-accused was granted bail by this Court who is having 28 previous cases, hence he seeks bail. https://www.mhc.tn.gov.in/judis 1/2

4. The learned Additional Public Prosecutor would submit that while pending trial in 302 case again the petitioner threatened the witness and such a case has been registered by the Inspector of Police, Lalapet Police Station in Crime No.487 of 2022 for the offence under sections 143,195A and 506(i) of IPC. The petitioner is the master brain behind the entire crime.

5. This is the fourth application for bail and the earlier applications for bail were dismissed on 11.11.2022, 12.12.2022, 27.02.2023. Taking into consideration the fact that there is no change in circumstances of the case even after dismissal of the earlier petitions,this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
