PRAYER :- Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling of records pertaining to the impugned order dated 27.01.2026 in No.85/UTA.2/2026 passed by the first respondent and modify the same and consequently direct the respondents to grant the ordinary leave of 28 days without escort to the Petitioner's brother, the prisoner, Ponnusamy, S/o. Karuppaiah LCT. No. 887 (PID No. 17069) serving life sentence at Palayamkottai Central Prison.

ORDER
[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the first respondent made in No.85/UTA.2/2026 dated 27.01.2026, seeking for modification of the condition imposed by the first respondent to the effect that the detenu will be accompanied by an escort during the entire ordinary leave period of 28 days 2/6
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. The detenu is undergoing life imprisonment at Palayamkottai Central Prison, Tirunelveli District.
4. The learned Additional Public Prosecutor appearing for the respondents brought to the notice of this Court that the detenu has already undergone sentence for 11 years, 10 months and 6 days. The petitioner's brother submitted a representation seeking for ordinary leave on the ground that the joint family property has to be shared among the parties and to attend the aged mother and to attend the father's 15th day customery rites.
5. The first respondent, through the impugned proceedings dated 27.01.2026 was pleased to grant 28 days ordinary leave, but imposed the condition that the detenu will be accompanied by an escort. Aggrieved by this condition imposed by the first respondent, the present writ petition has been filed before this Court.

6. In the considered view of this Court, the detenu has already undergone sentence of 11 years, 10 months and 6 days. Considering the grounds for which the oridinary leave has been sought for, we deem it fit to modify the condition imposed by the first respondent.

In view of the above, condition imposed by the first respondent is modified to the effect that the detenu will report before the foruth respondent daily at 5.30 p.m, during the entire period of ordinary leave The other conditions imposed by the first respondent shall stand as it is. The detenu shall be released from jail on or before 14.03.2026.
8. In the result, this writ petition is allowed in the above terms. Consequently, the connected miscellaneous petition is closed. [N.A.V., J.] & [P.D.B., J 11.03.2026 NCC : Yes / No Index :
