ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondent.
2. The petitioner is figuring as third accused in Cr.No.24 of 2020 registered on the file of the respondent, for the offences under Section 379 of IPC and Section 21(2) of the Mines and Minerals (Development and Regulation) Act, 1957.
3. The learned counsel for the petitioner states that the other accused were granted relief on depositing a sum of Rs.15,000/- and the petitioner herein also undertakes to deposit a sum of
Rs.20,000/-, to the account of Crime No.24 of 2020 before the Jurisdictional Magistrate. The Jurisdictional Magistrate will immediately transfer the said amount to the account maintained by the District Administration towards discharging social welfare activities. The District Administration is directed to spend the amount immediately and submit a user Certificate or Report to the Registry of this Court. Such deposit is non-refundable one without prejudice to the petitioner's defence in the trial.
4. Recording the petitioner's undertaking and subject to the aforesaid conditions, the Anticipatory Bail is granted. On such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.I, Thanjavur District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of eight weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
