Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order in Na.Ka.No.125/Ku.u.Ko/18 dated 11.05.2018 on the file of the 2nd respondent and quash the same as illegal and consequently direct the first & second respondents to grant permission for conducting public meeting and cultural programme in respect of CAVERY RIVER RIGHTS on 24.05.2018 at 5:00 p.m to 10:00 p.m or any other date venue at Old Fish market nearby Hajiyar Street, Kumbakonam, Thanjavore District dated 07.05.2018.

O R D E R

The only apprehension of the respondents is that under the guise of public meeting, the petitioner would indulge in procession and conduct the meeting even after 9:00 p.m.

2. The learned counsel for the petitioner would submit that they only intend to conduct public meeting and there is no procession involved. It is further submitted that the public meeting shall be conducted between 6:00 p.m. and 9:00 p.m. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the same, the objections raised by the respondents may not be correct.

4. In the light of the above submissions made by both the counsel, the impugned order dated 11.05.2018 on the file of the second respondent is set aside.

5. Accordingly, the petitioner is granted liberty to approach the Inspector of Police, East Police Station, Kumbakonam, Thanjavore District with a fresh representation seeking permission and on receipt of same, the Inspector of Police shall issue positive orders permitting the petitioner to conduct public meeting and cultural programme on any mutually agreed date, between 06:00 p.m and 9:00 p.m.

7. The Inspector of Police is also at liberty to impose reasonable conditions for the purpose of the conduction of public meeting. Accordingly, this Writ Petition is disposed of. However, there shall be no order as to costs.
