2026-06-11Honourable Mr Justice P.B. Balaji1 pages

CMP(MD).No.5340 of 2026 in SA(MD).SR.No.18932 of 2026 P.B. BALAJI, J., This petition has been filed seeking condonation of a delay of 73 days in filing the above Second Appeal.

2. The learned counsel appearing for the respondents has no serious objection to the delay being condoned.

3. I have also perused the affidavit filed in support of the application and heard the learned counsel for the petitioner. I am satisfied that the petitioner has made out sufficient cause for not preferring the Second Appeal within the prescribed time. The delay of 73 days has been sufficiently and satisfactorily explained.

4. Accordingly, the delay is condoned and this petition is allowed.

11.06.2026 trp Note: Registry is directed to number the Second Appeal if it is otherwise in order and list it for admission in the usual course and print the name of the counsel for the respondent in the cause list.
