Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 & A2, apprehend arrest at the hands of the respondent police for the alleged offences under Sections 420 and 506(i) IPC, in Crime No.123 of 2018 and seek anticipatory bail.
2.The learned counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. 3.Learned Government Advocate (Crl.side) appearing for the State submitted that the de-facto complainant provided his land for rental purpose to the first petitioner and the said land was damaged by the petitioners 1 and 2 and hence, the de-facto complainant requested the petitioners to surrender his land, but they refused to surrender the same and also threatened him.
4.Considering the facts and circumstances of the case and taking note of the fact that this case pertains to civil dispute, this Court is inclined to grant the relief of anticipatory bail to the petitioners.
5.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the https://hcservices.ecourts.gov.in/hcservices/
learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on each of them executing a separate bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Bhoothapandy, Kanyakumari District, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation. sd/- 16/05/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
