Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records in the order passed by the first respondent in Ku.AA.No.2814/A4/2021 dated 18.03.2022 and quash the same. ORDER

The petitioner has challenged the impugned order, dated 18.03.2022 seeking to cancel the registration granted to the petitioner in the year 2013 for Innova 25G model.

2. It the case of the petitioner that the petitioner spent about Rs.16,000/- for getting this fancy number but the respondents have proposed to cancel the same as the number was already allotted to the third respondent, herein.

3. The learned counsel for the third respondent submits that the third respondent was allotted with the aforesaid number on 04.03.2013 much earlier than the petitioner on payment of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD).No.6669 of 2022 additional charges for such allotment of number for a sum of Rs.40,00,000/-. He further submits that the petitioner cannot having any objection on this count and therefore, the petitioner's number is required to be changed.

The learned Additional Government Pleader for the respondents 1 and 2 submits that the mistake was committed by the Transport Inspector as the same number was allotted to both the petitioner and the third respondent. It is however, submitted that the said Inspector has also died and therefore, the respondents are unable to ascertain as to why and how the mistake was committed. He further submits that the respondents are willing to allot any fancy number that may be available to the petitioner. However, it would take two month time as there are rectifications to be made in the web portal.

Considering the above, I am inclined to dispose this writ petition by directing the respondents 1 and 2 to allot fresh fancy number to the petitioner within a period of three months from the date of receipt of copy of this order without collecting any additional amount from the petitioner. The respondents are directed to consider the request of the petitioner for allotment of fancy number TN-49-CV-0123, if same is available and has not been allotted to any other person. No costs. Consequently, the connected miscellaneous petition is closed.
