ORDER : The Court Made the following order :- The petitioner, who is arrayed as an accused in crime No.1987 of 2016 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of I.P.C. and hence, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State. 3.It is the case of the prosecution that the defacto complainant is the daughter of the petitioner and it appears that the petitioner's wife had a fixed deposit in her name and she appointed the defacto complainant as her nominee and since the wife of the petitioner suffered from cancer and got bedridden and the defacto complainant did not take care of her mother, she had executed a Will and gave consent to transfer the deposit amount into joint account and added the name of the petitioner and hence, the daughter of the petitioner has given complaint against her own father.

4.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

5.The learned Additional Public Prosecutor would submit that investigation is going on.

6.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
