Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings dated - 09-2014 and signed on 16.09.2014 of the 2nd Respondent in No. 234/E2/2014 and quash the same and consequently direct the 2nd Respondent to consider the application dated 28.02.2013 given by the petitioner for transfer of stamp vending place from kundrakkudi to karaikudi.

JUDGMENT

[Judgment of the Court was delivered by M.M.SUNDRESH, J.] https://hcservices.ecourts.gov.in/hcservices/ The writ appeal is filed against the order passed by the learned single Judge in W.P.(MD)No.15937 of 2014, dated 24.09.2014.

2. The learned single Judge has recorded the factual finding that the licence did not specify the premises in which the business will not be carried on, except the place of vending which is Karaikudi. The learned single Judge also noted the fact that the respondents/writ petitioners are doing business without any blemish from the year 2003 onwards. Furthermore, it was also recorded that the copy of the complaint given was not furnished and no enquiry was conducted.

3. In such view of the matter, we do not find any reason to interfere with the order passed by the learned singe Judge and the order dated 24.09.2014 in W.P.(MD)No.15937 of 2014 has been complied with by proceedings in Na.Ka.No.234/,2/2014, dated 08.06.2015. Accordingly, this Writ Appeal is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
