Respondents Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the respondent No.2 to withdraw the case in Crime No.766 of 2015 u/s 174 Cr.P.C. on the file of the respondent No.4 dated 28.12.2015 and entrust the same to the file of the respondent No.3 for an investigation of the case by a competent officer and file a final report before the Jurisdictional Magistrate within the stipulated time as fixed by this Court.

This Criminal Original Petition is filed seeking a direction to transfer the investigation in Cr.No.766 of 2015 from the fourth respondent to the third respondent. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.

3. The learned Government Advocate (Crl.Side) on instructions would submit that originally the case was registered under Section 174 Cr.P.C. and subsequently it was altered into for the offence under Section 306 I.P.C. and the investigation is going on in a correct direction and the final report will be filed within a period of four months.

4. Recording the said submission, this Criminal Original Petition is closed. Consequently, the connected Miscellaneous Petition is also closed.
