21.08.2025) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to dispose the Petitioner's appeal in Appeal No.5710 of 2019, dated 23.09.2019, against the order passed by the second respondent in Na.Ka.NO.2597/2019/E1, dated 7.9.2019 as expeditiously as possible and within the time stipulated by this Court.

O R D E R
The Writ Petition is filed seeking a direction to the fourth respondent to complete the proceedings pending on his file and pass final orders.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.From the typed-set of papers, it is clear that the Petitioner submitted an application seeking deletion of fifth respondent's name from the revenue records pertains to S.No.191/2, Kuvalakudi Village, Thiruverambur Taluk, Trichy District. Based 2/6
on the said application, enquiry notice was issued by the fourth respondent to the Petitioner and fifth respondent, in his proceedings in Na.Ka.No.Aa2/4389/2022, dated 10.09.2022. Till date enquiry proceedings are not completed.
4.the learned counsel for the impleaded fifth respondent would submit that a civil suit is pending in O.S.No.44 of 2024, on the file of Sub-Court, Thiruchirappalli pertains to the right over the subject property between the Petitioner and fifth respondent. In view of the pendency of the civil suit, the Petitioner is not entitled to seek mutation of revenue records before the authorities. 5.The Petitioner only seeks a direction to the fourth respondent to complete the proceedings initiated by him. It is always open to the fifth respondent to whom also enquiry notice was issued to appear before the fourth respondent to raise all his objections including the pendency of the civil suit. 6.In view of the same, without expressing any opinion on the merits of the matter, the fourth respondent is directed to complete the proceedings initiated in Na.Ka.No.Aa2/4389/2022, dated 10.09.2022 and pass final orders on its own merits, after hearing the Petitioner and fifth respondent within a period of 12 weeks from the date of a copy of this order.

7.With the above directions, the Writ Petition stands disposed of. No costs.
