ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The present Contempt Petition has been filed alleging violation of the orders of this Court dated 13.10.2022 made in W.P(MD) No.23614 of 2022.

2. According to the petitioner, the order of this Court has not been complied with. The petitioner originally filed writ petition in W.P(MD)No.23614 of 2022 seeking direction to the second respondent therein to complete the enquiry on the basis of the summon viz proceedings in A1/1555/2020 dated 11.08.2021. This Court by an order dated 13.10.2022 directed the authorities to complete the enquiry and pass appropriate final orders on merits and in accordance with law, after affording sufficient opportunity to all the parties concerned, within a period of four weeks from the date of receipt of a copy of the order. According to him, no enquiry was conducted.

3. The learned Special Government Pleader appearing for the respondents would submit that the private respondents filed a suit in O.S.No.11 of 2023, on the file of the II Additional District Court, Tuticorin and wherein, the writ petition 2/5

is also made as one of the defendant in the suit and the said suit is pending, that apart, land in question is Grama Natham. Therefore, when the suit is pending, the enquiry could not be completed.

Considering this aspect, the issue is pending before the Civil Court and the writ petitioner is also made as one of the defendant and hence, the rights of the parties should be decided in the civil suit.
