Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to issue patta in the petitioners name in respect of the property comprised in S.No. 708/15 situated at Keezhpaguthi, Kadavur Taluk, Karur District based upon the petitioners application dated 23.10.2024 and representation dated 18.11.2024 within a stipulated time period in accordance with law and for consequential orders.

ORDER

The petitioner seeks issuance of a Writ of Mandamus to direct the second respondent to consider the petitioner's application for issuance of patta.

2. With the consent of the counsel on either side, the writ petition is taken up for final disposal at the admission stage.

3. I have heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the repsondents.

2. The petitioner, based on his registered sale deed, has sought for Patta. The second respondent, according to the learned Additional Government Pleader, has already rejected the petitioner's application dated 28.10.2024. However, he would fairly conceeds that the said rejection was through SMS mode and no enquiry was conducted and opportunity was not given to the petitioner before the said rejection order dated 28.10.2024.

3. The case of the petitioner is that patta was also issued to his vendor, from whom the petitioner has purchased the property under a registered document for valid sale consideration. Therefore, considering the above, the second respondent shall conduct a fresh enquiry on the petitioner's application dated 23.10.2024 and also afford an opportunity of personal hearing to the petitioner and thereafter pass orders, on merits disposing of the petitioner's application for patta, within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition is disposed of. No costs.
