Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 3 to measure and demarcate his properties in Survey No.921 measuring 11.04 cents (446.76 sq.m) situated at Kattarimangalam Village, Nasareth, Palayamkottai Tirunelveli District, based on the petitioner's representation dated 17.02.2026.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to measure and demarcate his properties in Survey No. 921 measuring 11.04 cents (446.76 sq.m) situated at Kattarimangalam Village, Nasareth, Palayamkottai Tirunelveli District, based on the petitioner's representation dated 17.02.2026.

2.The petitioner along with his three brothers namely, Natarajan Gandhimathinathan and Avudaiyappan had purchased the land through document No1981 of 2013 dated 13/12/2023 from Saraswathi Ammal wife of Gandhimathinatha Pillai and other legal heirs of Gandhimathinatha Pillai. The schedule of property in the sale deed Document No.1981 of 2013 states that the total extent is 446.76 square metre and out of 9 shares only 8 shares to an extent of 397.12 square metre, ie., is 9.81 cents is sold. However, the petitioner is seeking to survey 11.04 cents but the sale deed states only 9.81 cents. The respondents shall survey the land as per documents alone and fix the four boundaries.

3.The first respondent is directed to take the assistance of the second and third respondents and survey the land. However, the first respondent shall issue notice to the petitioner as well as the 5th respondent and thereafter, conduct the enquiry and survey. If need be, the 1st respondent shall seek police protection from the 4th

respondent. The 4th respondent shall provide police protection, if it is sought by the 1st respondent. Therefore, the Court is directing the official respondents to adhere to the following Standard Operating Procedures:

a.The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b.After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c.If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
